Possible distributive justice frameworks for providing health care by general practitioners are discussed. The ethical considerations before and after the recent changes to the British National Health Service are contrasted, with particular emphasis on a possible ethical divide that has been produced between fund-holding and non-fund-holding general practitioners. It is argued that general practitioners in non-fund-holding practices can continue as ethical advocates for their patients and distribute health care within an egalitarian framework. However, those in fund-holding practices may now be (...) seen as interest advocates and may have to practise utilitarian distributive justice. Patient groups may be needed to ensure that these general practitioners are seen to act justly in the distribution of the health care resources for which they are now responsible. (shrink)

That space and time should be integrated into a single entity, spacetime, is the great insight of Einstein's special theory of relativity, and leads us to regard spacetime as a fundamental context in which to make sense of the world around us. But it is not the only one. Causality is equally important and at least as far as the special theory goes, it cannot be subsumed under a fundamentally geometrical form of explanation. In the latter half of the twentieth century, developed countries of the world have made tremendous strides in organ donation and transplantation. However, in this area of medicine, Japan has been slow to follow. Japanese ethics, deeply rooted in religion and tradition, have affected their outlook on life and death. Because the Japanese have only recently started to acknowledge the concept of brain death, transplantation of major organs has been hindered in that country. Currently, there is a dual definition of (...) death in Japan, intended to satisfy both sides of the issue. This interesting paradox, which still stands to be fully resolved, illustrates the contentious conflict between medical ethics and medical progress in Japan. (shrink)

“Towards a Theory of Taxation” is a proper theme for an Englishman to take when giving a paper in America. After all it was from the absence of such a theory that the United States derived its existence. The Colonists felt strongly that there should be no taxation without representation, and George III was unable to explain to them convincingly why they should contribute to the cost of their defense. Since that time, understanding has not advanced much. In Britain we (...) still maintain the fiction that taxes are a voluntary gift to the Crown, and taxing statutes are given the Royal Assent with the special formula, “La Reine remercie ses bons sujets, accepte leur benevolence, et ainsi le veult” instead of the simple “La Reine le veult,” and in the United States taxes have regularly been levied on residents of the District of Columbia who until recently had no representation in Congress, and by the State of New York on those who worked but did not reside in the State, and so did not have a vote. Taxes are regularly levied, in America as elsewhere, on those who have no say on whether they should be levied or how they should be spent. I am taxed by the Federal Government on my American earnings and by state governments on my American spending, but I should be hard put to it to make out that it was unjust. Florida is wondering whether to follow California in taxing multinational corporations on their world-wide earnings. (shrink)

This paper examines the impact that recent advances in clinical neurology, introspectionist psychology and neuroscience have upon the philosophical psycho?neural Identity Theory. Topics covered include (i) the nature and properties of phenomenal consciousness based on a study of the ?basic? visual field, i.e. that obtained in the complete dark, the Ganzfeld, and during recovery from occipital lobe injuries; (ii) the nature of the ?body?image? of neurology and its relation to the physical body; (iii) Descartes? error in choosing extension in space (...) as the criterion for distinguishing the physical and the mental; (iv) the technical distinction between sensing and perceiving; (v) why phenomenal Direct Realism is incorrect whereas epistemic DR and the representative theory are correct; (vi) the ontological and topological status of phenomenal space and physical space. This leads to considerations of the current ?binding problems? in neuroscience; the role of the brain mechanisms that construct the sensory fields of phenomenal consciousness; the ?homunculus? fallacy; the key difference between epistemic and non?epistemic perception as revealed by brain injury studies; and how the brain codes information, contrasting topological and vectorial coding, with particular reference to the binding problem. My conclusion is that the Identity Theory is incompatible with the scientific evidence from an integrated approach to modern introspectionist psychology, clinical neurology, and neuroscience. However, Cartesian Dualism is even more incompatible with the evidence. This leaves only two viable theories. The first is Bohr's theory of brain?consciousness complementarity. The second is the Broad?Price?Smythies theory of extension, which is a topological theory of the relation between phenomenal space and physical space. (shrink)

In this article, Lucas maintains the falseness of Mechanism - the attempt to explain minds as machines - by means of Incompleteness Theorem of Gödel. Gödel’s theorem shows that in any system consistent and adequate for simple arithmetic there are formulae which cannot be proved in the system but that human minds can recognize as true; Lucas points out in his turn that Gödel’s theorem applies to machines because a machine is the concrete instantiation of a formal system: therefore, for (...) every machine consistent and able of doing simple arithmetic, there is a formula that it can’t produce as true but that we can see to be true, and so human minds and machines have to be different. Lucas considers as well in this article some possible objections to his argument: for any Gödelian formula we could, for instance, construct a machine able to produce it or we could put the Gödelian formulae that we had proved as axioms of a further machine. However - as Lucas underlines - for every of such machines we could again formulate another Gödelian formula, the Gödelian formula of these machines, that they are not able to proof but that we can recognize as true. More general arguments, such as the possibility to escape Gödelian argument by suggesting that Gödel’s theorem applies to consistent systems while we could be inconsistent ones, are moreover refuted by Lucas by maintaining that our inconsistency corresponds to occasional malfunctioning of a machine and not to his normal inconsistency; indeed, a inconsistent machine is characterized by producing any statement, on the contrary human being are selective and not disposed to assert anything. Context: The past few years have presented us with a growing amount of theoretical research (yet that is often based on neuroscientific developments) in the field of enactive music cognition. Problem: Current cognitivist and embodied approaches to music cognition suffer, in our opinion, from a too firm commitment to the explanatory role of mental representations in musical experience. This particular problem can be solved by adopting an enactive approach to music cognition. Method: We present and compare cognitivist, embodied and enactive (...) approaches to music cognition and review the current research in enactive music cognition. Results: We find that, in general, the enactive approaches to human musicality are capable of explaining the basic relationship between a musical subject and a musical object according to a pre-conceptual and pre-linguistic form of understanding related to bodily motor expertise. This explanation does not rely on on sophisticated forms of representation. Implications: Proponents of enactive music cognition should, in our opinion, focus on providing a consistent explanation of the most basic level of musical understanding. Constructivist content: We hope to invite the constructivist community to engage with the discussions on the intersection between music and enactivism. (shrink)

Re/reading the Past is concerned with the discourses of history, from the complementary perspectives of Critical Discourse Analysis (CDA) and Systemic Functional Linguistics (SFL). The papers in the book stress the discursive construction of the past, focussing on the different social narratives which compete for official acknowledgement. Issues of collective and cultural memory are addressed, reflecting the "linguistic turn" in the Social Sciences. The book covers a range of discourses, interpreting texts from popular culture to academic discourse including the construction (...) and evaluation of past events in a variety of places around the world. It is especially timely in its focus on the construction of time and value in a post-colonial world where history discourses are central to on-going processes of reconciliation, debates on war crimes, and the issues of amnesty and restitution. As such the book fills a significant gap in interdisciplinary debates as well as in register and genre analysis, and will be of general interest to historians, political scientists and discourse analysts as well as students and teachers of ESP (English for Specific Purposes) and EAP (English for Academic Purposes). This article traces the multiple enactments of sex in clinical practices of transgender medicine to argue against the presumed singularity of ‘transexuality’. Using autoethnography to analyse my own experience as a trans patient, I describe my clinical encounters with doctors, psychiatrists and surgeons in order to theorise sex as multiple. Following recent developments in science and technology studies (STS) that advance the work of Judith Butler on sex as performatively reproduced, I use a praxiographic approach to argue that treatment practices (...) produce particular iterations of what sex (and transexuality) ‘is’ and how these processes limit and foreclose other trans possibilities. I consider the ethical, political and material-discursive implications of treatment practices and offer a series of reflections about the effects and effectiveness of current clinical practices and the possibilities for intervening in such processes in order that, following Annemarie Mol, we might (re)make sex (and transexuality) differently. 5-43 This article aims to consider the robust field of environmental history as a whole, as it stands and as it has developed over the past twenty-five years around the world. It necessarily adopts a selective approach but still offers more breadth than depth. It treats the links between environmental history and other fields within history, and with other related disciplines such as geography. It considers the precursors of environmental history, its emergence since the 1970s, its condition in several settings (...) and historiographies. Finally it touches on environmental history’s relationship to social theory and to the natural sciences as they have evolved in recent decades. It concludes that while there remains plenty of interesting work yet to do, environmental history has successfully established itself as a legitimate field within the historical profession, and has a bright future, if perhaps for discouraging reasons.
